1) The purpose of the deposit is to insure the Purchasers intent to purchase the Bengal described in this agreement. All but $100.00 is refundable if the Purchaser changes his/her mind to buy the cat/kitten prior to the initial veterinarian examination described in this agreement of sale contract. The above Bengal cat will be held for the purchaser and not be sold to any other buyer regardless. A breech of contract, either verbal, written, or through neglect or avoidance to communicate, on Purchasers part can jeopardize the chance of placing the Bengal cat in a new home quickly as possible. For this reason $100.00 of the deposit is NOT refundable.
Upon receiving documentation that the kitten has been spayed, Registry documentation (“Papers”) will be sent by mail to you. You may note that a leopard is registered with TICA as a “brown-spotted-tabby” this is how TICA requires the cat to identified. Rest assured your cat is a Bengal. If the buyer decides to place the Bengal cat in the care of any establishment for the welfare of the cat (i.e. Humane Society, or SPCA) the buyer will provide the breeder right of first refusal to re-take ownership of the kitten. INSTRUCTIONS: Defiant Cattery agrees to provide one healthy Bengal cat/kitten. Buyer agrees to take kitten to veterinarian of choice within three days of sale. If the kitten is diagnosed with any ailment buyer has choice of returning kitten for replacement of kitten with a kitten of equal value. If kitten establishes any ailments after vet certifies health it is upon the breeder to decide if it is due to buyers neglect. Defiant guarantees health otherwise, for 14 days after buyer’s veterinarian and good health is established have received it. After 14 days of ownership all costs incurred for health of kitten are buyers responsibility. The following Instructions in red are non-binding but highly recommended. Cat will not be fed milk or fish products. Upon arrival to new home keep cat separated from other animals and isolated to one room with litter box up until its first vet check or 3 days which ever comes last. This is meant to assure your cat will know where its litter box is, and if there is any health issues your other animals are assured their safety. If you are bringing your new Bengal into a new home with other cats and you do not quarantine your cat up until its vet visit you will void the health guarantee. If you do not have your kitten seen by a vet within 10 days of receiving kitty this will void my health guarantee. FEEDING You will undoubtedly have your own favorite nutritional diet plan. For the sake of your cat’s adjustment you do want adjust gradually from the cats current feeding program to yours. Try to feed it what I feed it at first and mix it up with your food for the first week. More specifically I feed my cats Science Diet kitten food as it’s hard food, and 3 times a week it’s wet food is Nine Lives Plus. Change their water once a day, some times twice. I don’t have strong feelings against other brands however I do know that Science Diet is best you can buy. I don’t feed table scraps. Please refrain. If you do, you are training your cat to seek out human food on counters. • GRASS: Some pets like to gnaw on grass. It’s not bad for
Bengals but the blades can upset their stomach. If you mince it up, it’s
safer to eat and not at all unhealthy. No one wants this to happen but what if it does become a necessity? You should know what to expect prior to it happening and by purchasing a Bengal cat from Defiant Breeders. By buying a Bengal cat from Defiant Breeders (Lars Hindsley), you accept the terms of our return policy. So let's cover all the details. First we should note that there are costs involved in making things right. Some of the costs you the buyer must accept and some of the costs Defiant Breeders accept. IF YOU ARE SHIPPED THE WRONG CAT IF YOUR BENGAL DOES NOT WORK OUT DUE TO UNACCEPTABLE DEMEANOR: We will replace it. You agree to pay shipping costs associated with the return the your cat, while Defiant would pay shipping costs associated in shipping replacement. Should the replacement cat also not work out a third and final replacement would be offered and no more. The option of a refund is at our sole discretion. The amount of money refundable will also be at our discretion.
Defiant guarantees health 14 days from time of delivery. After 14 days of ownership all costs incurred for health of kitten is your responsibility. After which at no time will Defiant be responsible for any costs attached to scheduled or unscheduled office visits. If during the first 14 days of delivery your Bengal cat becomes ill you agree to contact Defiant Breeders immediately for any non-invasive health issues. Essentially unless the kitten has an open wound or has been injured from a hit or fall, you agree to contact Defiant Breeders with any health concerns before taking your kitten to vet or clinic. Under no circumstances will Defiant Breeders be responsible for any emergency clinic visits or fees this is in direct conflict with our policy on contacting Defiant Breeders first with non-invasive health issues. Furthermore if you are with 40 miles of Defiant Breeders and you have concerns for general health that are non-invasive you agree to return the kitten to Defiant Breeders to eliminate any unnecessary vet visits. Failure to comply with this policy will void our health guarantee. It is at our discretion to replace your Bengal. There are many types of sicknesses and it will be at our option to replace the Bengal by our estimation. Example: Ear mites are not cause for replacing a Bengal. We will determine if its surroundings and eating habits or any other factor has impacted the cat’s health beyond any acceptable level. This also means that once your vet has seen your Bengal upon receipt from Defiant that we will not pay for health related bills, unless we can determine that in some way the Bengal was harboring an illness that could have originated while in our care. What if the Bengal expires? UNLESS through an autopsy a vet proves it
was a congenital problem. This decision once again is at our sole discretion.
This promise is null and void if you do not have a veterinarian see your
Bengal within 5 days of receiving it, or if your Bengal cat has come in
contact with any other cats or sick animals prior to your veterinarian
visit that clears your Bengal's health. Health Guarantee Exclusions: If you allow your cat out of doors this will immediately void the health guarantee. Failure to document a visit to your vet will void the guarantee. If you bringing it into a new home with other cats and you do not quarantine your cat until its vet visit will void the health guarantee. Failure to abide by instructions outlined in this agreement will void the health guarantee.
DRIVING RANGE SHIPPING BY AIR Likewise it will be your responsibility to pay for shipping the replacement Bengal to you. Defiant will take on responsibility of contacting the airlines and delivering the Bengal to the airline. We will ship to your nearest city served by the major airlines: Delta, US Air or American Airlines. If we do not have a Bengal available at the time of your contacting us, you must wait until the next litter of kittens are born or until we acquire any Bengal's through our breeding program with fellow breeders. LEGAL Any legal issues arising from the purchase of Bengal cat from Defiant Breeders will be settled through the New Castle County Delaware court system. Agreed to by signatures below: Seller Buyer *In either case outlined above, it will be Defiant Breeders right to replace your Bengal with any other similar type Bengal. This means if you originally purchased a Filial Bengal, we would replace the cat with a Filial Bengal, not an SBT. Similarly we will replace any SBT purchase with an SBT Bengal. We cannot however guarantee sex, colors or markings such as any of the following: male, female, traditional leopard, snow leopard, tri-color marble, or snow marble. NOTE: If we do not have a Bengal available at the time of your contacting us, you must wait until the next litter of kittens are born or until we acquire any Bengal's through our breeding program with fellow breeders.
